Abstract

The United States generates an immense quantity of solid and hazardous waste. There is, however, a growing shortage of facilities for the disposal of this waste.4 The Environmental Protection Agency (EPA) estimates that 80% of the existing solid waste landfills will dose by the year 2009,5 and only one hazardous waste facility has been put into operation since 1980.6 As Justice Rehnquist has noted, "while many are willing to generate waste... few are willing to help dispose of it."
